1. Agreement to Terms

By accessing and using the Dorky Daisy Photography website (the "Site") and booking our services, you accept and agree to be bound by the terms and provision of this agreement. These terms apply to all visitors, users, and clients who access or use the Site and our photography services.

2. Booking & Creative Fees

All photography sessions require a Creative Fee to secure your date and time on our calendar. This fee covers the time, talent, and logistical planning of your session. Your date is not reserved until both the digital contract is signed and the invoice is paid in full.

• Creative Fees are non-refundable.
• Except where specifically noted (such as the gifted 5x7 print for Pet Sessions), the Creative Fee does not include physical artwork or digital files.

3. Cancellations & Rescheduling

We understand that life (and unpredictable weather) happens. Our cancellation policy is as follows:

• More than 48 Hours Notice: Cancellations cannot be refunded but can be rescheduled at no cost on one occasion only per session. Additional reschedules will incur a new Creative Fee.
• Less than 48 Hours Notice: Cancellations within 48 hours of your appointment cannot be refunded or rescheduled. A new fee is required to secure a new appointment.
• Lateness: If you are 15 minutes or more late for your appointment, the session will be canceled, and a full session fee will be required to reschedule.

4. Purchasing & Fulfillment

Dorky Daisy Photography operates on a guided In-Person Sales (IPS) model to ensure you receive the highest quality heirloom products.

• All decision-makers must be present during your guided purchase appointment.
• Payment for artwork and digital files is required in full at the end of your purchase appointment.
• Because printed artwork and heirloom boxes are entirely custom-made to order, all sales are final once the order is placed.

5. Copyright & Image Usage

Lisa Sampietro and Dorky Daisy Photography retain the legal copyright to all images created during your session.

• Client Usage: Purchased digital images include a print release for personal use. Images may not be used by clients for competitions, commercial marketing purposes (unless a specific commercial branding license is purchased), re-sold, or used as reference material for artworks.
• Social Media: If images are shared on social media, they must not be altered in any way (no external filters), must not have logos removed (if applicable), and must be credited to Dorky Daisy Photography.

6. Safety & Behavior

Safety is our absolute priority. Should the photographer feel unsafe or uncomfortable at any time during the session based on client (or friends/family of client) behavior or attitude, the session can be canceled without notice and no refund will be given. Abusive or aggressive behavior will not be tolerated.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
